Terms of Service

This is an early version. We are a young company, we would rather say less and mean it than publish something that sounds complete and is not, and we will expand this as the service grows.

These terms cover your use of Empath Legal. Using the service means you accept them. They are written to be read, so they are shorter and plainer than most — where something is still being built out, we say so rather than promising the finished version.

What the service does

Empath Legal researches and analyses information to support you during jury selection. You give us case documents and a juror list; we research the individuals on it, organise what comes back, and produce analysis you can work from and edit.

It assists you. It does not decide anything. Nothing the service produces is legal advice, and no output is a recommendation you should follow without your own judgement. Every call remains yours.

The research is assembled from background-check and public-records providers and from publicly available sources, which may include images. Information from outside sources can be incomplete, out of date, or about the wrong person. Check anything before you rely on it.

Your account

You sign up yourself. Keep your sign-in details to yourself and keep them secure — anything done through your account is treated as done by you. An account is for one person; if others at your firm need access, they need their own.

How you may use what the service produces, and what we ask of you when you research the people on a juror list, are set out in the User Agreement.

Credits and payment

Work is bought as credits. One credit covers a case and a set amount of work on it — re-running a step, resuming, and asking follow-up questions all draw on that same allowance rather than costing another credit.

If a case uses up its allowance before it finishes, we stop and ask you. Continuing costs another credit and never happens without you authorising it, either by choosing to continue or by turning on an option that says to keep going. Nothing charges a card in the middle of a run.

A new account gets one trial credit, once. It runs a limited demonstration of the service rather than a full case, and it expires if it goes unused.

Subscriptions are billed yearly. Payments are handled by our payment provider — your card details go to them and not to us.

Prices can change. A change takes effect at your next renewal and never in the middle of a term, and we tell you before it does, so you can cancel first. What you have already bought keeps the terms you bought it under.

Refunds

We can refund a purchase in full, and doing so takes back the credits it granted that you have not yet spent. We do not offer a refund on the ground that the analysis was not what you hoped for — the service researches and organises, and what to rely on is your decision.

What you give us, and what you keep

The case documents, juror lists, edits and notes you put into the service stay yours. We do not claim ownership of them.

You give us permission to handle them for one purpose: running the service for you. That includes passing information to the companies we work with to deliver it — providers of background-check and public-records data, providers of publicly available information, cloud hosting and storage, the providers who run the AI models behind our analysis, our payment provider and our email provider. They act for us and use it for nothing else.

We do not sell or rent your information, and we do not use it to train AI models. The AI models behind the analysis belong to outside providers and are reached through their standard commercial interfaces, so what those providers do with what we send them is governed by their terms rather than by ours.

What we do with personal information generally is described in our Privacy Policy.

What belongs to us

The service itself — the software, this site, and the way the analysis is assembled and presented — belongs to us. You may use it to work on your matters. You may not copy it, resell access to it, take it apart to see how it works, harvest it automatically, or use it to build a competing product.

Availability

We work to keep the service running and to make it fast enough to be useful. We do not promise that it is available at all times, or that a case finishes within any particular time. Plan accordingly for anything with a deadline attached.

Keeping and removing your information

While your account is open we keep your material so the service can use it. Ask us and we will close your account and remove your case material from the live service.

Two honest limits on that. Some records survive — billing history, and records we need in order to show what was agreed and when. And we keep durable backup copies so a failure on our side cannot lose your work; the process that clears removed material out of those backups is still being built. We would rather tell you that than promise an erasure we cannot yet carry out end to end.

Ending this

You can stop using the service whenever you like. We may suspend or end access if these terms or the User Agreement are broken, or if we are required to.

Limits on our liability

The service is provided as it is. Because the research comes from outside sources and the analysis is produced by automated systems, we do not warrant that any result is accurate, complete or current, and you remain responsible for verifying anything you act on.

To the extent the law allows, we are not liable for lost profits, lost business, or indirect or consequential losses, and our total liability to you is limited to what you paid us in the twelve months before the claim arose.

Changes to these terms

We may update these terms. A new version is posted here with its date, and continuing to use the service after that means you accept it.

Governing law

These terms are governed by the laws of the State of Louisiana, and disputes belong to the courts located there.
